Conditions of Retail and Mail Order Sale
Norfolk Lavender Ltd (NL) Terms and Conditions of RETAIL SALE to all
Personal Customers buying at our PREMISES (including any temporary
premises e.g. Agricultural Shows etc) or on the INTERNET, or by MAIL ORDER.
- These Terms and Conditions of Retail Sale are made on behalf of
NL itself and all its staff and Directors. They apply only to sale
of goods (which includes all NL products, plants and all objects
which NL sells) to individuals for personal use, not resale, at
advertised retail prices when the total retail price of that sale
(excluding postage or transport) does not exceed £5,000.
- While we will do our best to advise, if asked, Customers must
choose their purchases for themselves and neither NL nor its staff
nor Directors can accept any obligation to supply samples nor goods
fit for any particular purpose nor goods which comply with any other
description than that given by us.
- A dissatisfied Customer may return goods, for replacement or refund
at Customer’s choice, provided that complaints about plants reach us
within 7 days of delivery to you and that complaints about any other
goods reach us within 14 days of delivery to you.
- Payment
- For goods must be made by cash, credit card or cheque at
point-of-sale or at time of purchase or order in £ sterling.
- For plants must be made by cash, credit card or cheque at
point-of-sale or at time of purchase or order in £ sterling.
In the case of plants, if we cannot despatch your plants within 15 working days,
your order will be acknowledged and your payment will be presented in order to
reserve the plants that you have ordered.
- Ownership of Goods/Acceptance of Order
- However made, whether orally or in writing, all Orders from
Customers are received by NL as Customer’s irrevocable offer(s)
to purchase stated goods, each such offer to be accepted by NL
by the delivery of relevant Goods in one or more despatches as
soon as NL circumstances allow, whether over the counter or by
post or carrier, each despatch constituting a separate contractual
acceptance.
Funds credited to a Customer’s account prior to the despatch of goods
or plants are a refundable deposit (in part or in whole) against the
eventual supply of such goods or plants and the acceptance
of a deposit does not constitute a contract to supply.
In the event of failure to supply, for whatever reason,
NL’s liability is limited to the value of the deposit.
- Ownership of Goods passes to Customer on each such despatch
as aforesaid.
- All monies received by NL from Customer in relation to any Order
or Orders are to be held by NL to Customer’s credit to be applied as
then appropriate to discharge of Customer’s obligation in respect of
each acceptance and despatch of Order or part of Order, and/or returned
pro rata to Customer if and in so far as NL are or become commercially
unable in NL’s opinion to accept such order or part of order.
- Orders to ship goods to destinations outside the UK will not be
accepted nor processed until NL is notified that payment in full of
price and any postage and packing charge has been received by Bank
for NL’s account.
- Delivery
- Product Orders for delivery in the UK. Goods other than
plants will be delivered (at our option, determined by size and
weight of parcel) by Royal Mail or carrier at the charge stated in
our offer or otherwise notified to Customer. Except at peak periods,
expect goods within five working days of NL’s receipt of order.
- Products to destinations outside UK. Goods will be despatched
by Airmail unless Customer otherwise chooses. Postage will be
charged and advised at the rate dictated by Customer’s choice.
- Plants (UK only) will be sent by first class post or two
day guaranteed delivery at the charge specified in offer for sale
or individually advised. Any plant order which cannot be despatched
within 14 days of receipt of order will be individually acknowledged
and estimated date of despatch advised.
Important for plant care. Customers for plants who may be absent
from the delivery address in the daytime must supply:
- Alternative delivery instruction if needed.
- An attended telephone number so that we can advise of arrival of plants.
- Urgent Orders
If your order is required for a particular date, we will do all
we can to help subject to an agreed additional charge.
- All Export Orders are at Customer’s risk once they leave
Caley Mill. If you wish we will seek insurance for the goods in your
name at your expense. Any delays caused by Customs and other
Regulatory bodies are outside our control and our responsibility.
- Save as above we cannot accept responsibility for any loss or
damage however arising in connection with orders, goods or plants and
expressly exclude all express or implied conditions or warranties,
statutory or otherwise, express or implied save as provided by the
Unfair Contract Terms Act 1977.
- This is an English Law Contract. These Terms and
Conditions do not affect your statutory rights.
- These Terms and Conditions do not apply to Trade Sales
which will continue to be on our Standard Wholesale Terms and
Conditions (2000 revision) which can be obtained at or by post
